The Iowa Court of Appeals has issued a reversal of a guilty sentence.  A Washington County jury in 2010 found then 27 year old Aaron Weiland guilty of the second offense of operating a motor vehicle while intoxicated relating to a January 2009 incident.

Weiland has appealed his judgment and sentence and the State’s evidence supporting the important factor of “under the influence” was not substantial as it wasn’t related to Weiland’s operation of a motor vehicle.

The finding of the jury has been reversed by the Appeals Court and the state has also found it not necessary to retry Weiland in the incident.
