A hearing on the Washington County Board of Supervisors motion to dismiss a lawsuit was held yesterday. The lawsuit filed by Residents for a Better Richmond Inc. (RBR) last November led to the board’s motion to dismiss in late December. The court denied the motion, and it was decided that a Motion for Summary Judgment would be more appropriate. Washington County Attorney Larry Brock says the decision was not unexpected. He adds more facts will be gathered and the issue will be discussed further with the board.

The lawsuit claims the board didn’t have the authority to enter into a project note, which the lawsuit refers to as a loan agreement, that guarantees R.U.S.S. will be paid for the work they’ve done, should the County decide to halt or not to go through with the Richmond lagoon project.
