Information provided by Donald Tormey with the Iowa Utilities Board.

Dakota Access, LLC, an Energy Transfer Company, has filed its petition for a hazardous liquid pipeline permit with the Iowa Utilities Board regarding a proposal to construct a crude oil pipeline across Iowa (the Dakota Access Pipeline, a.k.a. Bakken Pipeline). The filing has been assigned to Docket No. HLP-2014-0001.

Anyone seeking to file objections, comments, and letters of support in this docket do so by using the Board’s Electronic Filing System, citing the docket number, and clicking on the “Submit Filing” tab and following all instructions to log-in as a guest, to upload documents and receive a filing ID number. After the filing has been processed, the filer will receive e-mail notification including a link to the filing. If a filing is rejected, the filer will receive an automatic e-mail rejection notice from the IUB EFS Help Desk, along with a reason for the rejection. Notification of a rejected filing will not be provided to other parties on the service list or to the Office of Consumer Advocate or to Board staff. All documents in a rejected filing must be re-submitted once the appropriate corrections have been made. For help, contact the EFS Help Desk Monday through Friday, except State holidays,8 a.m. to 4:30 p.m. Phone: (515) 725-7337. Persons lacking computer access may file written comments by mailing them to the Iowa Utilities Board, Executive Secretary, Docket No. HLP-2014-0001, 1375 E. Court Ave., Rm 69, Des Moines, Iowa 50319-0069.

The Iowa Utilities Board has primary jurisdiction over the routing/siting, but not safety, of hazardous liquids pipelines in Iowa. Before a pipeline for the transportation of hazardous liquids can be built in Iowa, the company proposing the pipeline must obtain a permit from the Board under Iowa Code chapter 479B, Hazardous Liquid Pipelines and Storage Facilities. Hazardous liquids include crude oil, refined petroleum products, liquefied petroleum gases, anhydrous ammonia, liquid fertilizers, liquefied carbon dioxide, alcohols, and coal slurries. For additional information, review the hazardous liquids pipelines process and frequently asked questions about eminent domain.

Searching for Hazardous Liquid Pipeline Permit Filings

All public filings and Board orders regarding specific hazardous liquid pipeline permit filings (HLP-Docket) are available on the Board’s electronic filing system (EFS). To search for documents related to hazardous liquid pipeline permits, click the EFS link, select Search from the top navigation menu, and scroll down to Document Search. This will open a document search screen. Enter the docket number (HLP-YYYY-XXXX) relating to the permit for which you would like more information and click the Search button. This will provide a list of all documents filed online with the Board in that proceeding.

If you do not know the specific docket number, you must do a docket search to determine the docket number. To start, click the EFS link, select Search from the top navigation menu and scroll down to Docket Search. This will open a docket search screen. Select HLP – Hazardous Liquid Pipeline from the Docket Type drop down box and then select the company name from the Participants drop down box. Be sure to click the Add button to add the company to the search parameters. After entering the search terms, click the Search button to display a list of all documents filed in all HLP-dockets for that company.
