The court case against a Mount Pleasant man arrested in December for domestic assault has been dismissed because the defendant didn’t understand the charges filed against him.
The Henry County Sheriff’s Office arrested 21-year-old Derek Brake on December 18th after deputies responded to a 911 call shortly after 8 p.m. regarding a physical altercation in the 2400 block of Brandon Lane in Mount Pleasant. Their investigation led to the arrest of Brake on charges of domestic abuse assault impeding air or blood flow, a class D felony, and domestic abuse assault causing bodily injury, a serious misdemeanor.
Brake’s attorney claimed his client could not comprehend the charges against him and argued a defense of insanity and/or diminished capacity. Court records show a judge granted the motion and dismissed the State of Iowa case against Brake on April 19th.
