A Lone Tree man who was found guilty of assault in Washington County was arrested Friday for allegedly committing perjury.
The Washington County Sheriff’s Office arrested 40-year-old Marvin David Shilling on a warrant for the class D felony offense Saturday, according to the Washington County Communications Center. Shilling was originally charged with first-degree burglary, a class B felony, after he entered onto the property of another in Riverside without permission and after being asked to leave, assaulted one of the people on the property. County Attorney John Gish says on September 16th a jury found Shilling guilty of assault causing bodily injury, a serious misdemeanor, but not burglary. His office argued for the maximum of one year in jail, and noted that Shilling has several violent convictions, including domestic abuse strangulation causing injury, a class D felony. Despite Shilling’s violent history, the court sentenced him to a suspended 76-day jail sentence and placed him on unsupervised probation.
Shilling testified in his own defense on September 15th, and afterwards Gish says he immediately began working with the sheriff’s office to investigate his sworn testimony. They discovered several key instances where it was false. Shilling is being held on a $5,000 cash-only bond at the Washington County Jail. KCII will bring you more information as it becomes official.
