A Washington man was recently sentenced for a firearm offense as well as probation violation.
Court documents show that through a plea agreement 36-year-old Derek Brandon Morgan was convicted of control of a firearm by a felon, a class D felony, and given a suspended five year prison sentence to serve three years probation. Morgan must pay a $1,025 fine with a 15% surcharge and any pecuniary damages filed by the county attorney, but he was found not to have the reasonable ability to pay Category B restitution. This sentence will run consecutively with those of two other cases.
Morgan admitted to violating his probation on convictions of third degree burglary, a class D felony, and third degree theft, an aggravated misdemeanor, for incidents that occurred from August through September of 2019. He must serve 40 days in the Washington County Jail for each case to be served concurrently, with credit for time served since the arrest on the violation. He shall then continue to serve his probation. Morgan was charged with possession of a firearm after the Washington Police Department and Iowa Department of Corrections located two shotguns and ammunition at his residence during a home visit on December 19, 2020.
