An Ainsworth man who was previously charged with domestic abuse assault third or subsequent offense, a class D felony, has been ordered to serve 30 days in jail.
Twenty-eight year-old Dolan Jerald Rice was arrested last June on warrants for the felony as well as domestic abuse assault impeding airflow, an aggravated misdemeanor, for a May 30th incident. On June 1st, the victim went to the Washington County Sheriff’s Office with bruising on her arms, legs, and body; a deep laceration above her left eye; and a bruised black eye that appeared to be older than the other bruises. She also had her finger wrapped and in a splint as she believed it was broken from being grabbed by Rice. After reporting the assault, the victim was transported to Washington County Hospital and Clinics for treatment. The victim reported that she locked Rice out of the residence and he then broke through the window air conditioner. She also mentioned that in the past Rice has suffocated her with a pillow when he was angry.
Court records show that Rice’s felony charge was removed in July. Through a plea agreement, Rice was then convicted of a lesser charge of domestic abuse assault first offense, a simple misdemeanor. He must serve the aforementioned jail time with credit for time already served, complete the Iowa Domestic Abuse Program, and pay a $105 fine with a 15% surcharge and Category B restitution. Last February, Rice was convicted in Washington County of assault while displaying a dangerous weapon, an aggravated misdemeanor, and possession or carrying of dangerous weapons while under the influence, a serious misdemeanor. He pleaded guilty this month to violating his two-year probation period.
