Both suspects in a Fairfield murder have filed appeals with the Iowa Supreme Court, resulting in stays being ordered in each of their cases.

Late Tuesday evening, 16-year-old Willard Noble Chaiden Miller of Fairfield filed an appeal, regarding decisions made by District 8 Judge Shawn R. Showers. Miller’s attorney, Christine Branstad, argued in the appeal that the court was wrong to deny the defense a chance to challenge evidence they believe was not legally collected and in the decision not to bar the public and media from the reverse waiver hearing which would decide whether Miller would be tried in adult or juvenile court.

On Wednesday evening, in records that were made public on Thursday, 16-year-old Jeremy Everett Goodale’s attorney, Nicole Jensen, followed suit with an appeal, asking the Supreme Court to review the same decisions.

Both teens are facing first-degree murder and conspiracy charges stemming from the death of 66-year-old Fairfield High School teacher Nohema Graber. The hearings scheduled for March 24th did not take place and will remain on hold until the appeal is ruled on by the State Supreme Court.
